Purpose of a Will
We all know that the main intention of a Will, of course, is to transfer assets to the designated beneficiaries. It is definitely important that all individuals with combined families, or those who have no children, have a Will made up to ensure that their estates will be bequeathed to the desired inheritors.
But a Will also has other valuable intentions. Having a Will drawn up by an attorney frees up the probate process to move quicker and be much less expensive. A Will might call for an informal probate, rather than a formal probate. The distinction is that in a formal probate, the personal representative is mandated to go before court at least one time, and court review is necessary for all actions taken by the personal representative. Also, when you appoint the personal representative of your choice in the Will, you can feel assured that the individual you trust to carry out your wishes and have control over the estate will be able to do just that.
Another main objective of a Will is providing for children who are minors. Parents’ wishes are taken into account by the Court when appointing a guardian, and – although the Court must still authorize your choice – if these wishes are stated plainly in the Will, you can all but guarantee that the guardian of your choice will gain custody. A Will can also establish the mechanism to provide for financially for children who are minors or special needs with the creation of a trust that becomes effective after passing.
