Purpose of a Will
We all know that the primary intent of a Will, of course, is to move assets to the desired beneficiaries. It is absolutely important that all individuals with combined families, and those who have no children, have a Will made up to ensure that their estates will be transferred to the desired recipients.
But a Will has other beneficial purposes as well. Having a Will drawn up by an attorney allows the probate process to move quickly and be much less costlier. A Will might call for an informal probate, rather than a formal one. The difference is that with a formal probate, the personal representative is required to make a court appearance at least once, and court review is mandatory for all actions taken by the personal representative. Also, when you name the personal representative of your choice in the Will, you can feel assured that the person you trust to carry out your wishes and have control of the estate will be allowed to do just that.
Another primary objective of a Will is providing for children who are still minors. Parents’ preferences are taken very seriously by the Court when designating a guardian. And – although the Court must still authorize your selection – if these wishes are stated plainly in the Will, you can all but guarantee that the guardian of your selection will have custody. A Will can also set up the means to financially provide for children who are minors or special needs by establishing a trust that becomes effective after death.
