Family Law Mediation
Our family law mediator is Lisa Kallemeyn, who is a Qualified Neutral under Rule 114 of the MN Rules of Practice. She is an experienced mediator and has worked with parties from the metro area and Greater Minnesota. Lisa is conducting mediations via Zoom.
Mediation is a neutral voluntary process – we cannot force a party to participate. As evidence that you are volunteering to participate in the mediation process with my office, you will need to complete my Confidential Information form, which you can download and print here as a PDF form. Please return this completed form to our office along with a $50.00 non-refundable administration fee, which can be made via check mailed to our office or by using the PayPal account feature via the button at the bottom of this webpage.
Individuals may participate in mediation without attorneys, but remember that Lisa can not give legal advice. Any signatures on agreements reached in mediation are contracts and either party can demand enforcement through the courts.
In the event the other party does not volunteer to participate in mediation, we will provide you with a letter indicating you attempted to mediate through our office.
Agreement to Family Law Mediation
Ms. Kallemeyn will be able to prepare a written document that you both will sign to memorialize any agreements you reach at the session. However, she cannot draft any Court documents or dissolution paperwork for you as that is the duty of an attorney. Ms. Kallemeyn cannot be both your mediator and attorney. Remember also, that unless all parties agree in writing via a signed stipulation, everything discussed in mediation is confidential. This is addressed in the Agreement to Mediate, which will be sent with materials should parties agree to mediate with Lisa.
Process
Once we have a completed Confidential Intake Form and non-refundable $50.00 from party, our paralegal will email you both Lisa Kallemeyn’s availability. We block our mediation sessions for three hours, and they will occur remotely via Zoom.
We assume that parties will equally split the fees due unless you both come to a written agreement otherwise. Lisa Kallemeyn bills on a flat fee schedule for the full 3-hour session; therefore, the cost is $550.00 per party. No later than 14 days prior to the session date, we will provide a link to each party to pay the $550.00 deposit via debit/credit card. We will hold these funds until your session date to ensure attendance at the session. This deposit will fully cover your initial three-hour session. Full payment is due seven days prior to the scheduled session. If full payment is not made, the session will be cancelled.
Once a date has been set, we will send you written confirmation of the session, a copy of the Agreement to Mediate (which will also be sent for electronic signature the day of the mediation) and request certain documents for Lisa Kallemeyn to review prior to the session. You should not contact Ms. Kallemeyn regarding specific case aspects or questions about your case; our office must remain neutral and thus we cannot speak with one in advance of the session. All discussions will take place only during your scheduled mediation session, and you should consult with an attorney of your choosing outside of this office regarding any legal questions you may have. Feel free to review Mediation Tips & Anchors by downloading and printing here.
