Understanding family law, especially divorce law can be difficult, and Minnesota is a no-fault divorce state. No-fault divorce means that marriage can be broken and does not require proof that either party has done any wrong doing. You can file for divorce without having to provide evidence that someone has committed adultery or another act that breaks the marital contract. A dependable family law attorney will address all of the specifics in a case and can advocate for you adequately. Due to the no-fault divorce law there is potential that if someone has committed a wrongdoing, the court will not side on the party that has been hurt. The person that initiates the divorce, even if they broke marital contract, could potentially fare better than the other spouse and that is why it is important for you to get proper representation. Before they get married, some couples agree to a prenuptial agreement regarding specific issues like finances and property. Many people feel that this is a fair way to start a marriage. This way, if something goes wrong with the marriage and a divorce occurs, both parties involved are already at an agreement on how property and finances should be divided. This in turn tends to lower the amount of conflict during a divorce because some of the issues were resolved before the marriage even began. If you have a prenup, and you live in Minnesota, have you checked to see if it is valid? If you are not sure, your best bet is to reach out to Kallemeyn & Kallemeyn, PLLC, experienced family law attorneys that take pride in ensuring that your prenup meets the legal requirements.
